“You” and “your” mean the person purchasing, booking or participating in an EMPIXO service.
Who may provide your coaching or mentoring
EMPIXO coaching and mentoring services may be delivered by appropriately selected employees, contractors, financial mentors, supervisors or other authorised EMPIXO personnel. The individual providing a service may vary depending on the service, availability, experience, client needs and internal allocation.
Where an individual provider has specific qualifications, registrations, professional memberships or experience, EMPIXO may provide that information separately on its website or as part of the engagement process.
Unless expressly agreed otherwise, your service agreement is with TEAM YCBC ENTERPRISES LIMITED trading as EMPIXO, not with an individual team member personally.
EMPIXO remains responsible for services provided under your EMPIXO engagement, subject to these Terms and applicable law, regardless of which authorised EMPIXO team member delivers the service.
2. Relationship with the EMPIXO Terms & Conditions
These Coaching & Financial Mentoring Terms form part of, and should be read together with, the EMPIXO Terms & Conditions.
Where these specific service terms address a matter differently from the general Terms, these specific terms apply to the coaching service.
You should also read the:
- EMPIXO Privacy Policy;
- Refund, Cancellation & Rescheduling Policy;
- Mentoring vs Financial Advice page; and
- Disclosures & Complaints page.
3. What EMPIXO coaching is
EMPIXO helps people understand their financial position, strengthen financial capability, organise information, build practical systems and take informed action.
Our broader approach is:
LEARN → PLAN → ACT → LIVE THE OUTCOME

- scenario modelling;
- accountability;
- implementation support; and
- progress reviews.
The exact scope will depend on the service you purchase.
4. Our financial mentoring background
EMPIXO coaching is currently led by Brett Cole, the founder and lead practitioner.
Brett is currently listed on the FinCap register as a financial mentor and a financial mentor supervisor.
His status was confirmed as current in July 2026, and he is currently providing supervision to trainee financial mentors in New Zealand.
Brett’s financial mentoring and supervision experience supports the experience behind EMPIXO coaching.
These credentials are separate from regulated financial adviser status.
They do not, by themselves, make an EMPIXO coaching engagement regulated financial advice.
Information about the qualifications, registrations and experience of individual EMPIXO team members may be provided separately on the EMPIXO website or during the engagement process.
5. Coaching and regulated financial advice are different services
Unless you have expressly entered into a separate regulated financial advice engagement, EMPIXO provides coaching, mentoring, education, general information, decision support and practical implementation support.
Your coaching engagement is not intended to provide personalised regulated financial advice.
The substance of an interaction matters.
Calling something “coaching”, “education” or “mentoring” does not by itself determine whether an interaction amounts to regulated financial advice.
EMPIXO therefore maintains a deliberate boundary between its current coaching services and any future regulated financial advice service.
6. What EMPIXO may do during coaching
Depending on the service, EMPIXO may:
- explain general financial concepts;
- explain terminology;
- help you organise information;
- explain how types of financial products generally work;
- help identify financial risks;
- discuss general options;
- compare possible consequences and trade-offs;
- perform calculations;
- use hypothetical examples;
- help you understand financial documents;
- help you prepare questions for banks and other organisations;
- help prepare questions for accountants, lawyers and advisers;
- help you build financial systems;
- help you set goals;
- help you prepare an action plan;
- help you implement actions you have decided to take; and
- provide accountability and follow-up.
7. Where the regulated financial-advice boundary is reached
EMPIXO will not knowingly provide a personalised recommendation or opinion about acquiring, disposing of, changing or retaining a particular financial product where doing so would constitute regulated financial advice.
This may include personalised recommendations concerning a particular:
- mortgage;
- lender;
- lending product;
- KiwiSaver fund;
- KiwiSaver provider;
- investment;
- managed fund;
- security;
- insurance policy;
- insurer; or
- other regulated financial product.
If an interaction reaches that boundary, EMPIXO may stop that part of the discussion and recommend appropriately authorised regulated financial advice.
8. Future EMPIXO regulated financial advice
EMPIXO intends to develop a separate regulated financial advice service.
The first planned regulated advice area is:
Residential Mortgage Advice.
Future areas may include:
- investment advice;
- insurance and protection advice; and
- regulated KiwiSaver advice where appropriate.
These services are separate from current EMPIXO coaching.
They will only become available once the appropriate qualifications, licensing and/or Financial Advice Provider authorisation arrangements, adviser requirements and compliance processes are in place.
A future regulated advice service will have its own applicable terms, disclosures, adviser/FAP information, fees, conflicts information, complaints processes and engagement requirements.
Purchasing coaching does not automatically create a regulated financial advice relationship.
9. You remain the decision-maker
EMPIXO helps you understand, plan and act.
You remain responsible for your financial decisions.
You are not required to follow an idea discussed during coaching.
Where a decision requires specialist professional advice, you should obtain that advice before proceeding.
10. Banking Help
EMPIXO Banking Help may provide general education and practical support concerning everyday banking.
This may include:
- understanding different types of bank accounts;
- organising household banking;
- bills accounts;
- spending accounts;
- savings accounts;
- emergency-fund accounts;
- joint banking systems;
- separating personal and business banking;
- business bank accounts;
- direct debits and automatic payments;
- understanding bank statements;
- online and mobile banking education;
- banking administration;
- preparing documents for a bank;
- preparing questions before a bank meeting;
- understanding information a bank may request; and
- improving general banking confidence.
Banking Help is not a service provided on behalf of a bank.
EMPIXO does not represent that it can approve accounts, loans, transactions or banking decisions.
11. Power of Attorney and banking authorities
EMPIXO may provide general education and practical banking support where a Power of Attorney or other account authority is relevant.
This may include helping you:
- understand, at a general level, why an authority may be required;
- organise existing documents;
- prepare questions for a bank;
- understand practical banking processes;
- understand information a bank may request; and
- prepare for a meeting with a bank.
EMPIXO does not provide legal advice about:
- whether you should establish a Power of Attorney;
- what type of Power of Attorney you require;
- drafting a Power of Attorney;
- changing a Power of Attorney;
- interpreting disputed legal authority; or
- determining whether a particular legal document is valid.
Those matters should be referred to an appropriate lawyer or other legal professional.
12. Lending education within Banking Help
EMPIXO’s background includes more than 17 years of experience across banking and residential lending.
EMPIXO may provide general education about:
- how lending generally works;
- bank terminology;
- loan application processes;
- information banks may ask for;
- lending affordability concepts;
- preparing financial information; and
- questions to ask a bank or mortgage adviser.
Personalised recommendations about a particular lender, mortgage, loan, refinance option, lending product or lending strategy may amount to regulated financial advice.
Where that boundary is reached, the matter should move to an appropriately authorised financial advice service.
13. Bank security, fraud and scam awareness
Banking Help may include education about bank security, fraud and scam awareness.
This may include:
- phishing;
- impersonation scams;
- suspicious payment requests;
- unusual transfer requests;
- overseas payment concerns;
- internet-banking security;
- mobile-banking security;
- password safety;
- multi-factor authentication;
- remote-access software risks;
- account access concerns;
- vulnerable family members;
- large or unfamiliar transfers;
- preparing questions for a bank security or fraud team; and
- rebuilding safer banking habits after an incident.
EMPIXO may encourage a simple behavioural principle:
PAUSE BEFORE YOU PAY
Before making a significant or unusual payment, independently verify who you are dealing with, understand why the payment is being requested and seek appropriate help where something does not feel right.
This is financial capability education.
EMPIXO does not guarantee that it can determine whether a person, payment, transaction, website, business or investment opportunity is legitimate.
14. Urgent banking or fraud situations
EMPIXO is not:
- a bank fraud department;
- a cybersecurity provider;
- a fraud investigator;
- the Police;
- an emergency service; or
- a lawyer.
If you believe that:
- your bank account has been compromised;
- your password or authentication information has been disclosed;
- somebody has accessed your account;
- your card has been compromised; or
- money may have been fraudulently transferred,
you should not wait for an EMPIXO coaching appointment.
You should contact your bank promptly using an independently verified official contact method and take any other appropriate emergency or reporting steps.
EMPIXO may subsequently help you organise information, prepare questions and rebuild financial systems.
15. Passwords and banking security information
Never give EMPIXO your:
- internet-banking password;
- PIN;
- card PIN;
- one-time passcode;
- authentication-app code;
- security token;
- complete security answers; or
- other secret banking credentials.
Where EMPIXO helps you understand something displayed within an online account, you should remain in control of logging in.
16. Wealth Planning
EMPIXO Wealth Planning is a coaching, education and decision-support service.
It may include:
- long-term goal setting;
- net-worth planning;
- bringing income, assets, debts and goals together;
- scenario modelling;
- future planning;
- financial organisation;
- understanding trade-offs;
- decision support; and
- accountability.
Where planning moves into a personalised recommendation about a particular investment, KiwiSaver fund, insurance policy or other regulated financial product, that becomes regulated financial advice and sits outside the current coaching service.
17. KiwiSaver education and mentoring
EMPIXO may provide education and mentoring concerning KiwiSaver.
This may include general education about:
- how KiwiSaver works;
- contribution concepts;
- fund types;
- risk;
- fees;
- compounding;
- first-home withdrawal concepts;
- retirement considerations; and
- questions to ask a KiwiSaver provider or financial adviser.
EMPIXO coaching does not include personalised regulated KiwiSaver product recommendations.
Personalised regulated KiwiSaver advice is a future service and is not currently available through EMPIXO.
18. Tax & IRD Coaching
EMPIXO may provide financial coaching, education and practical support concerning Inland Revenue and tax-related financial organisation.
This may include:
- explaining general tax concepts;
- budgeting for tax;
- setting aside money for tax;
- organising IRD debt;
- understanding IRD correspondence;
- preparing information;
- financial mentoring relating to overdue obligations;
- preparing for conversations with IRD;
- preparing for conversations with an accountant; and
- helping establish better financial systems.
EMPIXO does not hold itself out as your accountant, tax lawyer or specialist tax adviser.
19. Tax specialist boundary
Where a matter requires:
- interpretation of tax law;
- technical tax advice;
- a technical tax opinion;
- specialist tax structuring;
- disputed tax treatment;
- determining whether a particular expense is deductible;
- specialist return treatment;
- formal tax representation; or
- legal advice,
EMPIXO may recommend that you work with an accountant, tax specialist, lawyer or other appropriate professional.
20. Xero and financial software support
EMPIXO may provide practical education and coaching relating to Xero and similar financial software.
This may include:
- understanding how the software works;
- organising records;
- improving workflows;
- understanding reports;
- preparing information;
- improving financial administration; and
- preparing information for an accountant.
Software coaching does not mean EMPIXO is providing an audit, accounting certification, formal tax opinion or specialist accounting service.
21. Small Business Coaching
EMPIXO may provide practical financial coaching to people starting, operating or organising a small business.
This may include:
- business cashflow;
- budgeting;
- separating personal and business money;
- savings and reserves;
- debt organisation;
- tax provisioning habits;
- Xero;
- banking systems;
- record keeping;
- financial organisation;
- scenario modelling;
- general pricing and break-even education;
- preparing for professional meetings;
- action planning; and
- accountability.
22. Business structures
EMPIXO may provide general education about common structures such as:
- sole traders;
- companies;
- trusts;
- LTCs; and
- other common ownership structures.
General education is different from recommending which legal or tax structure a particular client should use.
Where personalised structural, tax, accounting or legal advice is required, EMPIXO may recommend an appropriate professional.
23. Rental-property financial organisation
Where relevant, EMPIXO coaching may include general financial organisation relating to rental-property ownership.
This may include:
- cashflow;
- budgeting;
- debt organisation;
- record organisation;
- scenario planning; and
- preparing questions for professionals.
This does not constitute personalised property, legal, tax or investment advice.
24. Clubs & Community Organisations
EMPIXO may provide practical financial, administrative and organisational coaching to clubs, sporting organisations and community groups.
This may include:
- budgets;
- cashflow;
- reserves;
- funding planning;
- grant preparation;
- administration;
- committee systems;
- general governance education;
- policies and procedures;
- annual planning;
- accounting organisation;
- record keeping;
- member administration;
- volunteer administration;
- preparing information for accountants or funders; and
- implementation support.
25. Clubs and specialist professional boundaries
EMPIXO does not act as a club or organisation’s:
- lawyer;
- auditor;
- accountant;
- tax adviser; or
- formal governance adviser.
Where specialist legal, accounting, audit, tax or governance advice is required, the organisation should obtain that advice from an appropriate professional.
26. Couples, partners and joint coaching
With agreement, coaching may involve a spouse, partner or household member.
EMPIXO aims to remain neutral in joint coaching.
Each participant should have a reasonable opportunity to participate.
EMPIXO does not represent one partner against another.
EMPIXO may pause or end joint coaching where continuing becomes inappropriate, unsafe or misleading.
27. Children and young people
Standard EMPIXO coaching is intended for adults unless a programme states otherwise.
Where a person under 18 participates, EMPIXO may require parent or guardian consent, involvement, different privacy arrangements or additional safeguarding measures.
28. Team of Five and support networks
EMPIXO may encourage clients to develop a personal support network, sometimes described as a Team of Five.
You choose who participates.
Members may change over time.
Members of your support network do not become employees, agents or representatives of EMPIXO.
29. Referrals to specialists
Sometimes the best next step is specialist help.
EMPIXO may suggest or introduce you to:
- financial advisers;
- mortgage advisers;
- insurance advisers;
- investment advisers;
- accountants;
- tax specialists;
- lawyers;
- banks;
- lenders;
- community organisations;
- government organisations; or
- other appropriate professionals.
You remain free to accept or decline a referral and to choose another provider.
30. Referral payments and conflicts
If EMPIXO receives or may receive a material referral payment, fee, commission, incentive or other commercial benefit connected with a referral, this will be disclosed where required by law or where reasonably necessary for you to understand a potential conflict.
You remain free to choose another provider.
31. Authority to communicate with third parties
Your coaching agreement does not automatically authorise EMPIXO to act on your behalf.
Where you want EMPIXO to communicate with:
- a bank;
- lender;
- creditor;
- insurer;
- KiwiSaver provider;
- Inland Revenue;
- government organisation;
- accountant;
- lawyer; or
- another organisation,
a separate written authority may be required.
Any authority will be limited to the purpose for which it was provided.
Having authority to communicate with an organisation does not make EMPIXO your lawyer, accountant, tax adviser or regulated financial adviser.
32. Client money
Unless a future separately regulated service expressly provides otherwise, EMPIXO coaching does not involve taking custody or control of client money or financial assets.
You remain responsible for authorising transactions involving your money.
33. The quality of your information matters
Good coaching relies on good information.
You agree to make reasonable efforts to provide information that is accurate, current, complete and relevant.
EMPIXO may reasonably rely on information you provide.
Incomplete or inaccurate information may result in incomplete or inaccurate calculations, observations, scenarios or plans.
34. Draft and working financial information
Budgets, debt schedules, Money Maps, cashflow plans, business budgets and similar documents may initially contain estimates or incomplete information.
Until verified they should be treated as:
DRAFT / WORKING FINANCIAL INFORMATION
Where appropriate, important figures should be checked against reliable source documents.
35. EMPIXO Money Map and other tools
EMPIXO may use:
- EMPIXO Money Map;
- spreadsheets;
- calculators;
- worksheets;
- financial software;
- models;
- forecasting tools; and
- other decision-support technology.
Unless expressly stated otherwise, these tools provide education and decision support.
Their outputs are not automatically personalised regulated financial advice.
36. Uncertainty and estimates
Where EMPIXO does not have enough reliable information, we may identify information as:
- estimated;
- incomplete;
- unknown;
- unverified; or
- requiring further investigation.
EMPIXO would rather identify uncertainty than present an estimate as fact.
37. Examples, scenarios and forecasts
Examples, calculations, forecasts, assumptions, scenarios and “what if?” exercises are provided to support understanding and decision-making.
They are not guarantees of future outcomes.
Actual outcomes may differ materially.
38. No guaranteed outcomes
EMPIXO does not guarantee that coaching will produce a particular financial result.
This includes guarantees concerning:
- income;
- debt reduction;
- lending;
- mortgages;
- IRD arrangements;
- business performance;
- funding applications;
- investment performance;
- KiwiSaver performance;
- insurance outcomes;
- savings;
- net worth; or
- another financial objective.
39. Fees and GST
The price of your service will be shown on the relevant website page, booking page, proposal, invoice, payment page or written agreement.
Unless otherwise stated, prices are in New Zealand dollars and include GST where applicable.
Unless otherwise agreed, payment is required before the service begins.
40. Booking notice
Paid EMPIXO coaching appointments may require a minimum booking lead time.
Unless otherwise stated for a particular service, appointments must normally be booked at least 24 hours in advance.
This requirement exists to allow EMPIXO reasonable time to review the reason for the booking and prepare for the session.
41. Booking confirmation
Where payment is required, a booking may not be treated as confirmed until:
- payment has been successfully received; and
- the relevant booking confirmation has been issued.
42. Cancellations, refunds and rescheduling
The EMPIXO Refund, Cancellation & Rescheduling Policy forms part of your service arrangements.
Unless another service-specific condition has been clearly disclosed:
- 24 hours or more before the appointment: free reschedule or full refund;
- less than 24 hours: normally no refund and the session may be treated as used;
- no-show: normally no refund;
- exceptional circumstances: EMPIXO may exercise reasonable discretion; and
- if EMPIXO cancels: a replacement appointment or refund for the affected session will ordinarily be offered.
Nothing in this section removes a consumer right that cannot lawfully be excluded.
43. Packages and programmes
Where a package or programme has a completion or expiry period, that period will be clearly disclosed before purchase.
If no completion or expiry period is stated for the particular service, these general Terms do not create one.
Individual appointments may remain subject to the applicable cancellation and rescheduling rules.
44. Online services
Services may be delivered by video meeting, telephone, email, online platforms, client portals or other technology.
You are responsible for reasonable access to suitable technology and connectivity.
No online system can be guaranteed to be completely secure or uninterrupted.
44A. Clients outside New Zealand
EMPIXO is founded in New Zealand and works online with clients in New Zealand and internationally.
If you are outside New Zealand when you purchase or attend an EMPIXO service:
- EMPIXO provides general financial education, coaching, financial clarity and action support;
- EMPIXO does not provide regulated financial, investment, mortgage, insurance, legal or tax advice under the laws of your country, and is not authorised to do so;
- EMPIXO’s regulated financial advice services are New Zealand-only and are separate from coaching (see sections 5, 7 and 8);
- where your needs cross into regulated financial advice, tax, legal or other country-specific professional services, EMPIXO may stop that part of the discussion and suggest you speak with an appropriately qualified professional in your own jurisdiction. You remain responsible for obtaining that advice;
- prices are in New Zealand dollars unless otherwise stated. Currency conversion and any bank or card fees are set by your card provider; and
- session times are shown in your local time zone when you book. Please check your confirmed time, especially around daylight-saving changes.
Section 61 (Governing law) continues to apply, including any mandatory rights you have under the laws of your own country.
45. Artificial intelligence and technology
EMPIXO may use AI-assisted and other technology for purposes including:
- administration;
- preparation;
- meeting summaries;
- transcription;
- workflow management;
- document preparation;
- financial data organisation;
- quality checking; and
- client follow-up.
AI can make mistakes.
AI-generated material should not automatically be regarded as accurate, complete, professional advice or a perfect record of a conversation.
Appropriate human judgement remains part of EMPIXO’s processes.
46. Recording and transcription
EMPIXO does not state that every session will automatically be recorded.
Where EMPIXO intends to make an audio or video recording of a private coaching session, appropriate notice or consent will be obtained where required.
Where an AI note-taking or transcription system materially records or processes a private conversation, appropriate notice or consent will also be used where required.
47. Privacy and confidentiality
EMPIXO will handle personal information in accordance with applicable privacy law and the EMPIXO Privacy Policy.
Information disclosed during coaching will normally be treated as confidential.
Information may nevertheless be used or disclosed where authorised, reasonably required to provide the requested service, legally required or permitted, or where another lawful basis applies.
48. Financial abuse, coercion and safety
Financial difficulty can involve financial abuse, coercive control, exploitation, intimidation, fraud or family violence.
EMPIXO is not an emergency, family-violence, mental-health or counselling service.
Where specialist support appears appropriate, EMPIXO may pause coaching, recommend specialist assistance or end an inappropriate joint coaching arrangement.
49. Communication between sessions
Purchasing coaching does not create unlimited access to EMPIXO.
EMPIXO may establish reasonable working hours, communication channels and response expectations.
EMPIXO is not an emergency service.
50. Your responsibilities
You are responsible for:
- attending appointments;
- participating in the process;
- providing relevant information;
- checking important information;
- completing actions you choose to undertake;
- asking questions where something is unclear;
- telling us when circumstances materially change; and
- making your own decisions.
Coaching is collaborative.
51. Respectful participation
EMPIXO may pause, refuse or end a service where continuing would reasonably be unsafe, unethical, unlawful or outside EMPIXO’s role.
This may include abusive behaviour, deliberate dishonesty, unpaid fees, serious unmanaged conflicts or requests for EMPIXO to participate in illegal or fraudulent conduct.
52. Other professional advice
EMPIXO coaching is not a substitute for specialist:
- legal advice;
- tax advice;
- accounting advice;
- audit services;
- medical advice;
- mental-health advice; or
- regulated financial advice.
Identifying an issue worth investigating does not mean EMPIXO is providing that specialist advice.
53. Intellectual property
Unless otherwise stated, TEAM YCBC ENTERPRISES LIMITED owns or licenses EMPIXO’s brand, frameworks, materials, worksheets, educational resources, software, Money Map content and other original resources.
Client materials are generally supplied for the client’s own personal, household, business or organisation use.
They may not be commercially reproduced, sold, republished or used to create a competing commercial service without permission.
54. Testimonials and client stories
Being an EMPIXO client does not automatically give EMPIXO permission to publicly use your name, photograph, financial information, story, testimonial or identifiable results.
Appropriate permission will be obtained before identifiable client material is used publicly.
55. Third-party platforms
EMPIXO may use independent providers for website hosting, bookings, payments, email, video meetings, cloud storage, software, AI, accounting and other operational purposes.
Those providers may operate under their own terms and privacy policies.
56. Information and circumstances change
Financial information, laws, tax rules, products, government processes, interest rates and personal circumstances can change.
Information discussed during an earlier coaching session may later become outdated.
Important information should be checked before significant decisions are made.
57. Liability and consumer rights
Nothing in these Terms excludes, restricts or modifies a legal right or liability that cannot lawfully be excluded, restricted or modified.
Subject to that qualification and to the maximum extent permitted by law, EMPIXO is not responsible for indirect, consequential, speculative or opportunity losses resulting from decisions you independently make following coaching.
These Terms are intended to operate consistently with applicable New Zealand consumer law.
58. Complaints
If you have a complaint about an EMPIXO coaching or financial mentoring service, contact:
EMPIXO Complaints
TEAM YCBC ENTERPRISES LIMITED
Email: info@empixo.com
Please explain what happened, what concerns you, the outcome you are seeking and any relevant supporting information.
EMPIXO will make reasonable efforts to consider the concern fairly and respond within a reasonable period.
Future regulated financial advice services will have separate complaints and dispute-resolution information where required.
59. Ending the coaching relationship
You may stop coaching subject to applicable cancellation conditions, charges already properly incurred, package conditions and consumer rights.
EMPIXO may also end a coaching relationship where continuing is no longer reasonable, safe, ethical or appropriate.
Provisions intended to continue after termination may survive, including privacy, confidentiality, intellectual property, accrued payment obligations and liability provisions.
60. Changes to these Terms
EMPIXO may update these Terms as its services, technology, business processes or legal and regulatory requirements evolve.
The version normally applying to a purchase will be the version in effect when that service was purchased.
61. Governing law
These Terms are governed by the laws of New Zealand unless mandatory law requires otherwise.
Clients outside New Zealand may also have rights under mandatory laws applying in their jurisdiction.
62. Severability
If part of these Terms is found to be invalid or unenforceable, the remaining provisions continue to apply to the extent legally possible.
63. Entire coaching agreement
These Coaching & Financial Mentoring Terms should be read together with:
- the EMPIXO Terms & Conditions;
- relevant service descriptions;
- the EMPIXO Privacy Policy;
- the Refund, Cancellation & Rescheduling Policy;
- booking information;
- payment information; and
- any specific written terms applying to the service.
Where a specific service term clearly conflicts with a general term, the more specific term applies to that service to the extent of the conflict.
64. Acceptance
By electronically accepting, purchasing, booking or commencing an EMPIXO coaching or financial mentoring service after being given access to these Terms, you confirm that:
- you have had an opportunity to read them;
- you understand the nature of the service;
- you understand that coaching and mentoring are separate from regulated financial advice unless a separate regulated advice engagement is entered into;
- you remain responsible for your own financial decisions; and
- you agree to these Terms.
